Is BOCW applicable to every Indian highway construction project?
Yes if the site meets either threshold: 10 or more workers on any single day in the preceding 12 months, OR project cost exceeds ₹10 lakh. Almost every NHAI / state PWD highway project crosses both. The contractor must register the site within 30 days of work commencement, register each worker with the State BOCW Welfare Board, and pay the 1% cess on construction cost. Many subcontractors believe BOCW only applies to building work — this is incorrect; the Act covers "construction works" broadly, explicitly including roads, bridges, tunnels, and earthworks.
What is the difference between IRC SP:55 and IRC SP:84?
IRC SP:55-2014 is specifically about traffic management in work zones — the geometry of advance warning, transition tapers, activity zones, buffer spaces, channelising devices, and signage placement on roads where construction work is happening alongside or within live traffic. IRC SP:84 is the broader Manual for Safety in Road Construction — covers worker PPE, excavation slopes, lifting operations, equipment operator competency, embankment edge protection, hot work safety, electrical installations. Most highway projects must comply with both — SP:55 for the traffic/work-zone interface, SP:84 for everything else inside the work zone.
How often must a BOCW safety audit happen on a highway project?
Daily — internal safety walks by the contractor's safety officer (the 8-step walk in this checklist); Weekly — joint walk with the Engineer's representative on most NHAI contracts; Monthly — formal EHS report submission to client and NHAI; Quarterly — BOCW Welfare Board inspection (random or scheduled); Six-monthly — Independent Quality Audit (IQA) where contracted. Surprise inspections by District Labour Officer / Factory Inspector / NHAI IE can happen anytime. The mandatory minimum is the daily and monthly cycle; the smart contractors run all five.

Does the main contractor carry liability for subcontractor BOCW non-compliance?
Yes — under the principal employer doctrine in Indian labour law. The main contractor is the principal employer for all workers on site, including subcontractor labour. BOCW Section 2(1)(j) defines "employer" broadly enough to include the main contractor for subcontractor workers. In practice this means subcontractor failures flow up — if a subcontractor's labour is unregistered, has no PPE, or is untrained, the BOCW inspector cites the main contractor, not the subcontractor. The contract may allow recovery from the subcontractor's running bills, but the regulatory action falls on the main contractor. This is why subcontractor compliance documentation must be on the main contractor's audit-readiness folder.
